To the extent permitted by law, Genetic Technologies and Atlas Sports Genetics, LLC. disclaims and will not be accountable for any and all warranties, either expressed or implied, including but not limited to any warranty regarding performance, the implied warranty of merchantability, fitness for a particular purpose and non-infringement of the third party rights with respect to the test, result (certificate) or report.
To the extent permitted by law, Genetic Technologies excludes all liability (including losses, damages, costs and expenses of whatever nature and any indirect and consequential losses, economic losses or any loss of profit, loss or opportunity, loss of savings, loss of interest or otherwise) to you regardless of the nature of the claim, whether in contact, negligence (or any other tort), breach of statutory obligation or otherwise arising from the test, result (certificate) or report.
This disclaimer shall be read subject to any statutory provision which applies to supply of the test, result (certificate) and report to you and any term condition, warranty and obligation which cannot be excluded or modified except to a limited extent.
If such statutory provisions apply, then to the extent permitted by law, Genetic Technologies' liability will be limited (at Genetic Technologies' option) to either the payment of the cost of having the goods or services supplied again or the supply of the goods and services again.
Testing of the ACTN3 gene is covered by US patent application number 10/527831 assigned to Genetic Technologies.
As with all genetic tests where family members are tested, the result may indicate non-relatedness.
